Public Video Recording Laws in Texas

When it comes to making a video or audio recording in Texas, consent is a very important issue. Texas has laws on the subject known as “one-party consent” laws. This means that if a person in a group agrees that the conversation can be recorded, then a recording is legal. “There is a widespread and persistent pattern of law enforcement officers ordering people to stop taking photos of public places and harassing, detaining and arresting those who do not comply.” The recording of videos or the “filming” of a police officer in the performance of his or her official duties is a right protected by the First Amendment of the United States Constitution. This amendment provides for freedom of expression, freedom of the press and freedom of assembly. Tex. Strafgesetzbuch Ann. § 21.15(c); 21.16(g): Violating Texas video recording laws is a state prison offense punishable by imprisonment ranging from 180 days to 2 years and a fine of up to $10,000. Your defense attorney might also argue that you didn`t intend to invade someone`s privacy or use images of them for sexual gratification. However, under the new law, enacted in 2015, a prosecutor does not have to prove the intent of the person who made the registration.

If so, you need to be aware of Texas laws for such offenses — and seek out an experienced Houston defense attorney to protect your legal rights. As a general rule, the ACLU of Texas recommends that if you are imprisoned for photos, videos, or audios, “remind officers that photographing is your First Amendment right and does not constitute a reasonable suspicion of criminal activity.” Texas` admissions law requires it to be a state with unilateral consent. In Texas, it is a criminal offense to use a device to record or relay communications, whether wired, oral, or electronic, without the consent of at least one person involved in the communication. This means that in Texas, you are legally allowed to record a conversation if you are a contributor or with the prior consent of one of the parties involved, subject to criminal intent. It is also legal to record electronic communications that are easily accessible to the public. Strafgesetzbuch Ann. § 16.02 (Vernon 2011). There are certain circumstances under which video recording is not allowed. If a person does not obtain their prior consent, it is illegal to record: the group further states that the police “cannot delete your photos or videos under any circumstances” and that professional police officers realize that their work is “subject to public scrutiny, including by the citizens who photograph them”. Not all states operate under the one-party approval standard. About a quarter of U.S. jurisdictions use the bipartisan consent rule.

In these states, you need permission from all parties involved to legally record a private conversation. Be very careful when recording phone calls/messages with people outside of Texas. Make sure you know the relevant laws before registering without permission. If you have specific questions about your rights or obligations, contact an experienced privacy attorney in Texas for legal advice. A lawyer will be able to review your issue and help you understand your legal rights. It is also a crime in Texas to photograph or film, broadcast or transmit a visual image of another person in a bathroom or locker room if the recording is made without the consent of the other person and the recording or broadcast is made with the intent to invade the privacy of the other person; or if, with knowledge of the nature and content of the photograph, recording, broadcasting or transmission, promotes a photograph, recording, program or transmission. Even if you do everything according to the rules and use your constitutional right to record, you may encounter a police officer who demands that you not take videos or photos. Another possible defense against an inappropriate photograph charge could be false identity. You may not be the person who actually took the photos or recordings. Let`s say Dave calls Megan.

In most cases, Dave is allowed to record the conversation, even if Megan doesn`t know the call is being recorded. That`s because Dave accepted admission. Dave can also record a phone conversation between Megan and Alice if Megan agrees to be recorded. This is because Megan is involved in the conversation and has agreed to the recording. “The First Amendment protects photographs, videos, and actual recordings, and for that protection to be meaningful, the amendment must also protect the act of creating that material. There is no practical difference between allowing the police to prevent people from taking recordings and actually prohibiting their possession or distribution. You may not even have to go to court. In fact, the subject of these images may be reluctant to proceed with a public process in which their identity and images can be revealed.

This means that a plea bargain agreement may be possible to reduce or even dismiss the charge and avoid litigation. To replace it, Texas` new Inappropriate Photography Act prohibits invasive visual shooting of personal intimate areas without their consent and with the intent to invade their privacy. In most cases, you can take videos or photos of someone who is prominent on public property. On the other hand, if the person is on private property, it is the owner who sets the rules. If you are on private property and the landlord asks you to leave the property, you must do so or be arrested for trespassing. Texas has very specific laws about when and where it is legal to record video or audio. These laws often focus on the issue of consent. This means that in certain circumstances it may be illegal to register someone who has not consented to the recording. Nowadays, almost everyone seems to have a digital camera or phone with video recording technology in their pocket. People use this technology to take photos and videos in many different places and situations.

However, in some situations, video or audio recording may be illegal. In Texas, penalties for inappropriate photography and invasive visual photography can be severe. Criminal sanctions for a state prison crime may include: A lawyer representing an accused of making illegal recordings may challenge the charge in court. In many cases, this type of defence will involve the question of consent. If the lawyer can present evidence that the defendant obtained consent prior to admission, the charges may be dropped. In other cases, the lawyer may be able to negotiate a plea. Participation in any of these activities may result in criminal charges. If a person makes illegal recordings and attempts to distribute, sell or trade them, charges can be laid even if that person did not create the original recordings. The ACLU also informs you that your legally acquired videos or photos on your phone or other device are your property and cannot be seized by the police. Putting up a sign informing people that they are registered in a private place is not the same as obtaining consent. These signs do not constitute a legal defense against non-consensual private recordings. In fact, the courts have always ruled that you can make videos of police officers performing their duties in public, as long as you don`t get in their way or impede their ability to do their job.

In Texas, it is a crime to photograph, record, broadcast or transmit a visual image of another person`s “intimate area” without first obtaining the other person`s consent if the other person has a reasonable expectation that the intimate area will not be publicly visible; and the recording or broadcast is done with “intent to invade the privacy of the other person.” But first, according to Texas law, what is improper registration? A person who illegally records a phone call, electronic communication, or face-to-face conversation can also be charged with a crime. In addition, the law allows a person who becomes a victim of such recordings to sue the convicted person for $10,000 for each violation. Aren`t you involved in the conversation? You cannot legally make a secret audio recording of a private telephone conversation between someone other than yourself without obtaining permission from at least one participant. The consent of at least one person who is actually leading the conversation. Since you, as a non-participant, cannot do it, someone else has to do it. “Other electronic means” may include video recording or taking photos using a mobile phone or other similar device. You may know someone who was wrongly arrested by the police, and the video of the incident may have proven their innocence. The recording, possession or distribution of illegal recordings is punishable by very severe penalties. In Texas, a person accused of making an audio or video recording of another person without consent and with intent to invade their privacy or arouse sexual desire can be charged with a crime in a state prison. A conviction for this charge may result in: If you receive a photo or video containing sexually explicit material and then share it with another person, it could be a criminal offence if you know that the subject of the photo or video did not consent to be photographed or filmed.
